Problematic issues of the implementation of criminal liability for abuse of official powers by employees of the education system

He main problematic issues of the implementation of criminal liability in relation to officials abusing their powers can be divided into three groups: features of qualification and problematic issues of implementation arising from law enforcement officers; features of qualification in the presence of circumstances precluding criminality of the act; features of sentencing, or the application of criminal law measures. According to the presented study, a comprehensive analysis of criminal law measures to counteract crimes of corruption related to the abuse of official powers by persons carrying out managerial activities in the education system is carried out. Related corpus delicti, competition of general and special corpus delicti were analyzed. Based on the questionnaire survey the opinion of law enforcement practitioners and pedagogical staff on the changes in the sanctions of Art. 285 of the Criminal Code of the Russian Federation was examined. Recommendations are presented to increase the level of effectiveness of preventive measures and the realization of the goal of punishment through compliance with the principle of humanity.
