Problem Issues of Compensation for Damage Caused by State Officials, Including Law Enforcement Agencies

Introduction: this study provides a comparative analysis of legal regulation in the field of compensation for damage caused by government agencies and their officials in both the Russian Federation and the Kyrgyz Republic. In addition, the experience of a number of foreign countries was considered, which allowed the identification of common problems and shortcomings in the legal practice existing in these jurisdictions. The study included a comprehensive analysis of the opinions and scientific approaches of domestic and foreign scientists, which contributed to a fuller understanding of the existing legislative models and mechanisms of compensation for damage. Based on the findings, practical proposals for the introduction of effective and optimal mechanisms aimed at improving the process of compensation for damage caused by the actions (inaction) of state structures were developed. Methods: the following methods of scientific analysis were used in the study: comparative legal method, which allowed the identification of the features and differences in the legal regulation of relations between the Russian Federation and the Kyrgyz Republic; a system approach, providing a holistic perception of the phenomena under study; and methods of axiomatic and functional research, contributing to a deep study of the regularities and functions of legal institutions. Results: the study analyzed the legislation of the Russian Federation and the Kyrgyz Republic and some foreign countries. The possibilities of using the positive experience of the two states are considered. Various authors’ concepts and approaches to solving the problem have been analyzed. Conclusions: it is advisable to establish specialized financial funds for compensation for damage caused by illegal decisions, as well as illegal actions or inaction on the part of government agencies and officials. These funds can become an important tool to protect the rights of citizens and ensure fairness in matters of compensation for damage.
