Problems of proof advocatory position in a criminal case

The article is devoted to topical problems that arise in a process of proving advocatory position in a criminal case. The paper identifies problems of implementing advocatory powers to collect evidence. Supported the thesis about necessity to eliminate legislative gaps in the regulation questions of advocatory participation in the evidentiary process in order to achieve real equality of parties of the criminal process and increase the level of legal assistance provided by advocates. The article contains arguments that support the validity of the opinion about necessity to adopt legal norms that provide advocates with equal opportunities with the prosecution in proving and implementing their position.
