Problems of formation of "electronic document" legal construction in national and international law

The purpose of the study is to reveal the main parameters of digital document flow, determine national and international regulatory legal regulation of the category of an electronic document, identify problematic issues in the field under study in the context of digitalization of law, establish priority areas for the implementation of legal resources and forms of development of electronic document flow in society and the state. Research objectives are to determine the content of the legal "electronic document" construction, identify the features of national and international legislative regulation of electronic document flow, establish the main characteristics of legal means necessary for the effective use of an electronic document as an important condition and potential for technological development in modern Russia. The tasks set are implemented by identifying topical problems of electronic document flow in various fields (civil, judicial, etc.) both on the territory of the Russian Federation and in the context of international electronic document flow with references to legal acts and bills of Germany, France, as well as the United Nations. The attempts to improve electronic document flow, as well as actions to create unified universal standards for electronic signatures, have already been listed in the framework of other studies, as well as in the proposed state programs and other projects. Research carried out an overview of the current acts regulating electronic document circulation in the territory of the Russian Federation, as well as European legislation in this area. The study gives the analysis of the current legislation and other forms of regulation in the field of the use of electronic documents, considers obstacles to the further development of electronic document flow as one of the integral components of the information society. As a result, a regulatory legal solution to the problems identified in the article is proposed.
