The author considers issues related to the establishment of rights to digital assets, in particular cryptocurrency, when they are resolved in court. Analyzes the case of failure of the court of first instance in making a cryptograph belonging to the debtor to the bankruptcy estate. Considers it necessary compulsory identification of digital assets and cryptocell according to their classification criteria when considering such cases in court. Makes a conclusion about the possibility of using existing means and methods of forensic examination, since the general economic laws are unchanged.
