Problems of the effectiveness of the rule-making of executive authorities

Introduction: based on the analysis of the current legislation and scientific literature, the authors examine and discuss the issues of organizing the effective impact of law on public relations. The authors denote that mechanism of legal regulation is possible only on the basis of a harmonious system of legal acts headed by the norms of law. They note the value of legislation and regulations of executive authorities in conjunction with legal means of implementation of the law. The authors pay special attention at delegated rule-making as one of the important form of the activities of executive bodies that need assessment. Materials and Methods: legal framework of the study was decrees of the President of the Russian Federation and the resolutions of the Government of the Russian Federation regulating the procedures of legal monitoring and assessment of the actual impact. The methodological basis was the dialectical approach to the knowledge of the content and essence of the law-making activity of executive authorities, as well as general scientific and private research methods. Results: based on the analysis of legal enactments, as well as scientific literature, proposals were formulated to improve the effectiveness of the rule-making of executive authorities, the specifics of the effectiveness of this activity were determined, elements of the rule-making activity of executive authorities were identified. Attention was drawn to the need to improve special methods for evaluating the effectiveness of the normative activity of executive authorities, allowing timely and adequate response to the needs of social development.
