The problems of health care workers qualification actions performing duties or providing services without meeting security requirements

The article deals with a debatable issue of the legal evaluation medical personnel actions in performing their duties or providing services that don’t meet safety requirements (article 238 of the Criminal Code). It is noted that nowadays the Russian criminal law does not react properly on the problem, causing quite serious problems in law enforcement. Its formation in the framework of this aspect today is based on the principle of precedent that certainly cannot be considered quite normal. At the same time, the current tendency is quite logical in nature, not only because of the passivity of the legislator, but also because of the simplistic approach to the solution of this problem by the law enforcer himself. Its solution would seem to be primarily done at the level of transformation approach to this kind acts qualification, and that is the subject of this research.
