Problems of qualifying crimes against persons in a helpless state

The processes related to the qualification of criminal acts are one of the fundamental areas of criminal law. The correct qualification of the committed criminal act determines the subsequent movement of the criminal case, and this applies both to the stage of preliminary investigation and the stage of consideration of the criminal case in court. The criminal legislator defines the qualification of criminal acts as the definition and legal fixation of the absolute conformity of the characteristics of the committed act to be analyzed with those characteristics of the components of criminal acts that are directly provided for by separate criminal law norms.
