Problems of law enforcement practice for trademarks protection and parallel import in the Republic of Kazakhstan

The author of the article deals with the problems that arise in law enforcement of trademark protection in Kazakhstan. In his opinion, this is due both to the lack of appropriate concepts and definitions in the Kazakhstan legislation, and because the practice of trademark protection in the countries of the Customs Union does not correspond to each other. It is concluded that in Kazakhstan, with the necessary laws to protect the market from «parallel» imports «gray» imports almost legalized, aided by a controversial position of governmental authorities, including the judicial practice of considering civil and administrative cases.
