The problems of recognition the homeowners’ shared ownership to basements

The article discusses the problem of recognition the homeowners ’shared ownership to basements in apartment buildings. In judicial practice two opposing positions have been formed: the first says that for recognizing the homeowners’ right to basements as to shared property it is enough to determine the availability of engineering services or other equipment that are provided for more than one apartment in the house; the second states that the availability of engineering services and equipment is insufficient for recognizing homeowners’ shared ownership to basements.
