This article analyzes the current controversial issues of the application of criminal law in relation to the leader of organized crime. The article examines the relevance of the adoption of legislative measures to improve the criminal law in this area. The article analyzes the practice of applying the criminal law against the leaders of criminal groups at the present time and the prospects for legislative improvement. The prerequisites for the legislative elimination of existing conflicts in the current legislation are summarized.
