Problems of realization of a lawyer's right to receive information and request information by means of lawyer inquiry

Purpose: The analysis of separate provisions of the Federal law № 160-FZ «About introduction of amendments to articles 5.39 and 13.14 of the Russian Federation Code of Administrative Offences and the Federal Law «About Lawyer Activity and Legal Profession in the Russian Federation» and elaboration of suggestions for improvement of the legislation on lawyer activity regarding obtaining data and information the lawyer by means of lawyer inquiry. Methodology: In work comparative and legal, formal-legal methods were used. Results: In a comprehensive study of the Federal law № 160-FZ «About introduction of amendments to articles 5.39 and 13.14 of the Russian Federation Code of Administrative Offences and the Federal Law «About Lawyer Activity and Legal Profession in the Russian Federation» and comparisons of his provisions to standards of the current legislation imperfection of the made changes has been revealed and ways of elimination of the shortcomings complicating realization of the right of the lawyer for obtaining data and information by means of lawyer inquiry are offered. Novelty/originality/value: In the present scientific article authors have for the first time conducted a complex and in-depth research of the Federal law № 160-FZ «About introduction of amendments to articles 5.39 and 13.14 of the Russian Federation Code of Administrative Offences and the Federal Law «About Lawyer Activity and Legal Profession in the Russian Federation». Article contains original scientifically based conclusions and offers which are of a certain value as from the point of view of the theory of the right, and useful to experts lawyers.
