Problem of foundation of the intellectual rights court in Russia

The author examines the legal problems associated with the creation in Russia of the first specialized arbitration court – the Court for intellectual property rights, in particular, the competence of the court involved a specialist in the arbitration process (his legal status order of attraction, the form of participation, payment services). The activity of such courts in Germany, Japan and the United States. The examples of Russian courts of arbitration practice. Proposed solutions to the problems identified. It is concluded that the emergence of a specialized Russian arbitration court will enhance the effectiveness of the protection of intellectual property rights, but the mechanism of protection needs to be improved.
