Problems of a Criminal Law Nature in Determining the Size of Illegal Production and (or) Turnover of Ethyl Alcohol, Alcoholic, Alcohol-Containing and Tobacco Products

Introduction: the article analyzes the problems of approaches to determining the size of ethyl alcohol, alcoholic, alcohol-containing and tobacco products withdrawn from illicit trafficking. Materials and methods: the materials were court decisions that came into force, scientific research. The methodological basis of the research was made up of comparative legal, dialectical-materialistic, systemic-structural methods. Research results: in the course of the study, the author considered the problem of the lack of a common understanding of the qualitative and quantitative characteristics of the subject of the composition provided for in Article 171.3 of the Criminal Code of the Russian Federation, which leads to qualification errors. The problem of the regulatory vacuum of legislative consolidation of uniform minimum prices for all types of counterfeit products, including counterfeit ones, has been established. Discussion and conclusion: the author comes to the conclusion that in order to eliminate problems in determining the size of counterfeit products, it is necessary to establish a transparent mechanism for determining the pricing of its value and its legislative consolidation.
