The criminal-legal regulation issues of public relations, associated with the requirements violation of preservation or maintenance of cultural heritage sites in the Russian Federation

The article is defined the issues of norms application of the criminal legislation, aiming to criminal-legal cultural heritage sites protection (monuments of history and culture) of the Russian Federation peoples, detected cultural heritage sites. There are analyzed the issues of crimes classification, coming under Article 243.1 and 243 of the Criminal Code of Russia; there are criteria for differentiation of these elements. There are stated proposals to amend the provisions of Article 243.1 disposal of the Criminal Code of Russia with the purpose to clarify the crime committer characteristics, as well as the note to Article 243.1 of the Criminal Code of Russia in order to overcome contradictions in the interpretation of the “destruction” term of cultural heritage sites (monuments of history and culture) of the Russian Federation peoples. In the article it is noted that the criminal legislation of the Russian Federation is not been effectively to solve the issues of requirements violation of preservation or maintenance of cultural heritage sites.
