The problems of establishing the subjective elements of the offences stipulated by articles 174 and 174.1 of the Criminal Code of the Russian Federation

The article describes the problems of establishing the characteristics of the subjective side of elements of crimes (in particular, forms of guilt), specified in articles 174 and 174.1 of the Russian Criminal Code (hereinafter-Criminal Code). The author cites the opinions of various members of criminal law science and foreign legal acts. In conclusion, the authors point to the need for changes to the legislative structure of the considered composition, as one of the main priorities of the criminal policy of the Russian state is providing decriminalization of the economy by law-enforcement, supervisory and regulatory bodies and by other state agencies, in modern conditions it can not be achieved without effective counteraction to legalization (laundering) of proceeds obtained by criminal means.
