The problems of possessory protection in Russian law

The article are considered the topical issues of possession and possessive protection in the Russian law, the condition of modern science of civil law in this area is analyzed, gives a comparative analysis of the problems of possessive protection in Russia and in the European countries (Germany, France, Switzerland) on various historical stages of the civil law development. In article it is noted that the main questions of the theory of possession in the Russian civil law, for example, about essence of possession, a ratio of the property right and possession, structure of participants, the contents and ways of protection of the right of possession still are debatable. The article is also devoted to identification of prospects of development of possessive protection of possession in Russian law.
