The problems arising in the process in which criminal cases are tried by jury

The article dwells on the analysis of the problems arising in the process of operation of the jury system in the Russian Federation. The author of the article points out that the full implementation of the jury system in Russia will result in development of the state’s judicial system, as well as in increasing the legality of judgement in criminal proceedings. The effective functioning of the jury in Russia is currently compounded by such problems as the low level of the Russians’ legal awareness, the mistrust of the jury and the unwillingness to participate in its work, the lack of the jury’s experience with trial concerning difficult legal situations within actual criminal proceedings, the restricted possibility of the jury’s implementation, the possibility of financial bribery and pressure on the jury. The success in solving the mentioned problems, as well as the expansion of the categories of criminal cases which can be tried by jury are to be regarded as the necessary conditions of the most effective functioning of the jury.
