Problems of detention of a person with special legal status at the crime scene

The existing issue of procedural detention of a person suspected of committing a crime with a special legal status is considered relevant in the modern realities of criminal proceedings. From the point of view of criminal procedure, this coercive measure is considered by us in a dynamic context, not only from the point of view of the textual content of the law, but also from the point of view of its actual application in investigative and judicial practice, as well as at all stages of investigation and consideration of criminal proceedings without exception. On the basis of the semantic-legal analysis of the current criminal procedure legislation of the Russian Federation, applied in the activities of authorized law enforcement officials, taking into account the investigative and judicial practice developed in this part, the article formulated a number of proposals with regard to the formation of rules for the direct procedural detention of a suspect with a special legal status.
