Observation, financial improvement and external administration or debt restructuring procedures

The author analyzes the proposed changes in the rehabilitation procedures in bankruptcy in the draft law of the Russian Economic Development. Compares the current situation in legislation and judicial practice and the model of the company’s debt restructuring proposed by the authors of the project. Concludes that, in general, the direction of development of rehabilitation institutions proposed in the draft law is correct, but a number of practical aspects need to be adjusted and supplemented.
