The article covers problems of the genesis of servitude as a juridical phenomenon and peculiarities of appearance of this institute in the legislation system of Russia. The article notes that one of the peculiarities of the origin of servitude among East Slavs was the possibility to provide every farmer with necessary farming acreage under the conditions of vast territories and insignificant population. Increasing population brought along conflicts between owners of neighboring plots and the necessity of servitudes. A number of servitudes arouse over objects, which provide branch crafts that allow decreasing dependence on the crop yield of a definite land but not over main agricultural activities on farming. Herewith, the use of such servitudes as “beavers’ estrus”, “apicultural units” was targeted largely at commodity production not at consumer production. Appearance of servitude rights among definite subjects resulted from investiture on behalf of a state, but not from agreement of interests of individuals.
