Prosecutorial supervision of observance of the rights of juvenile citizens to the accessibility of primary general education

Introduction: the article examines the supervision of prosecutorial authorities over the observance by educational organizations of the rights of minor citizens when enrolling them in elementary school, if it is necessary to maintain a balance of interests between citizens who have the right to extraordinary, priority, primary admission to education and citizens who do not have these "benefits". Materials and methods: the normative basis of the research is formed by the Constitution of the Russian Federation, federal laws, by-laws of the Prosecutor General of the Russian Federation, regulating the organization of the prosecutor's office, public relations arising in the field of education. The methodological basis of the study was the general dialectical method of scientific knowledge, which is universal in nature, as well as the methods of logical deduction, induction, cognitive methods and techniques of comparison, analysis, generalization and description. Results of the study: the results of the study allowed: to argue the relevance of prosecutorial supervision over the observance of the right of minor citizens to the general accessibility of primary general education; identify areas of prosecutorial supervision in this area of legal relations; to show that the application by heads of educational organizations of an extraordinary, priority, preemptive right to admit citizens to study has its own legal boundaries and if these advantages are unreasonably given to one citizen, the rights of other citizens are violated, which requires the timely application of prosecutorial response measures. Findings and conclusions: the legality of providing benefits when enrolling children in an educational institution for training under the primary school curriculum should be a special subject of prosecutorial supervision, since misinterpretation and application of laws in this field by educational organizations leads to a violation of the constitutional right of an unlimited number of minor citizens to have access to education.
