About Counteracting the Criminal Cases Hear-ing Concerning Violent Crimes Committed by Officials and Systematic Tactics to Overcome It

During the court hearing on criminal cases that involve violent crimes committed by officials, it is necessary to take into account the specific nature of this category of cases and the parties. The public prosecutor in the vast majority of cases is faced with situations of active and passive opposition to judicial investigation, aimed to prevent the establishment of circumstances which are subject to proof, and avoid any punishment. Sh.V. Outlev notes that “countering judicial investigation is an activity at the stage of judicial investigation that prevents obtaining reliable information about the crime in question” [1, p. 9–10]. In turn, V.Y. Belitsky considers counteraction to judicial investigation as a special type of counteraction, consisting in obstructing judicial inves-tigation as part of judicial proceedings [2, p. 163].
