Distribution of digital outdoor advertising and activity of classifieds: problems of legal regulation

The article discusses the legal regulation of advertising activities in the Russian Federation, namely the introduction of new provisions in the law “On Advertising” regarding the distribution of digital outdoor advertising and the installation of digital advertising structures, as well as the regulation of classifieds. The new rules are planned to be introduced in order to increase the ability to control the sphere of advertising, as well as the sphere of ads of individuals and legal entities. At the same time, the stated goals of the bill and its provisions differ significantly. Also, the provisions of the analyzed draft law containing new requirements for digital outdoor advertising contain a number of unprocessed formulations that contradict the current legislation, and the regulation of the activities of classifieds is generally outside the scope of advertising regulation. In addition, the legislator proposes to regulate relations that, in fact, have already been settled and do not need additional regulation. The planned amendments to the law “On Advertising” may entail a number of serious problems, which may have an extremely negative impact on the development of not only the advertising business, but also the entire sphere of entrepreneurship, since advertising is a means of promoting goods, work and services on the market.
