Consideration of the cases concerning administrative offences in the field of migration by courts of the Buryat Republic: some theoretical and practical problems (based on generalized judicial practice)

The article deals with application of legislation on administrative liability of foreign nationals in the field of migration by the courts of the Buryat Republic in 2013-2015-s, and legal positions of The Russian Federation Constitutional Court and The European Court of Human Rights. Exemplified by the judicial practice we have revealed the typical violations of the rights of foreign nationals and highlighted the need to apply the rules of international law in the cases concerning administrative offenses in the field of migration because of active migration processes.
