Realization of the constitutional principle of freedom of labour at temporary transfers to another job

The content of the principle of freedom of labour is considered by authors ambiguously. In Soviet period it meant, first of all, the ban of operation of the worker in the course of work and was more likely the principle of socialist society, but isn't right. The modern jurisprudence assigns to the principle of freedom of work more important part. The main component of the principle is the ban of forced labor which isn't combined in any way with Soviet «a duty to work». In our opinion, the intersectoral constitutional principle of freedom of labour concerning its impact on the labor relation should be considered in two values: in positive and negative sense. In positive sense the principle of freedom of labour is expressed in an option of a kind of activity and a profession. In negative sense the principle of freedom of labour is expressed in a ban of forced labor. Initial edition of the Labour code of 2001 contained the norm, allowing to transfer workers without their consent to another job in case of production need. According to L.Yu.Bugrova's remark, changes of the Labour code of 2006 provide refusal of transfers by production need and introduction instead of them of the transfers caused by force majeure. However, temporary transfers without a consent of workers remained, including, in cases of idle time, replacement of the absent worker. The cases of temporary transfer specified in the Labour code without a consent of the worker can't be referred to force majeure fully. The legislator means possibility of transfer without the need for elimination of consequences of force majeure or their prevention that has to be qualified as forced labor. Norms about temporary transfers create preconditions for abuse of the employer of the right to translate the worker without his consent to other work. Thus, because h. 3 Art. 72.2. of the Labour code Russian Federation contradicts Art. 2 of the Convention No. 29, item 2 of Art. 4 of the Convention on protection of human rights and fundamental freedoms and to parts 1 and 2 of Art. 37 of the Constitution of the Russian Federation, to recognize the specified provision of the Labour code become invalid.
