Implementation of the principles of the social state in terms of constitutional and legal regulation

Introduction: the article consistently considers the main provisions that characterize the social state as a legal and social reality. The paper analyzes the views of scientists on the problems and theoretical concept of the social state. Comparative analysis of the genesis of the legal phenomenon of the “social state” allowed the author to identify a number of patterns that demonstrate the constitutional and legal aspect of the state of social orientation. The provisions of the article, that address the problems of the social state, will significantly improve the sphere of social security if they are implemented in practice. Materials and Methods: the normative basis of the work is the Constitution of the Russian Federation, as well as the basic laws of other states regulating the sphere of social security. The methodological basis of the research is the general dialectical method of scientific knowledge, as well as methods of logical deduction, comparative legal method, analysis, synthesis and other tools that allow us to investigate the legal reality effectively in the sphere of social orientation of the state. Results of the Study: allowed us to study the constitutional legal relations in the social sphere and in the aspects of the principles of redistribution at the state level. An attempt is made to identify the characteristic features of the social state as a legal category. Findings and Conclusions: the basic principles of building a social state as a legal and social reality are revealed.
