Reformed cassation form for reconsideration of judicial decisions in criminal law: regulatory content and practice

At present, one of the most discussed issues in the science of criminal procedure and enforcement practice is the issue of a reformed institute of cassation proceedings. Its relevance was generated not only by a number of new laws of a judicial-systematic and judicial-proceeding character, but also by the place and significance of the cassation form for reviewing sentences and other court decisions that entered into force in the Russian mechanism for reviewing judicial acts. Interest is caused by the introduction of previously missing elements into the content of the cassation proceedings institute, in particular, the procedure for continuous cassation, the “perpetuity” of the right to appeal, the extension of the subject of cassation review, and the abuse of the right to appeal. Examples are given from the practice of the new court of cassation.
