Purpose: To study the principles of a systematic approach to the identification of types of medical malpractice and to the peculiarities of investigation of such cases, as well as personal responsibility of employers and employees in the health sector. Methodology: Materials of criminal and civil cases, as well as the pre-trial reports of doctors-experts of the Compulsory Medical Insurance System, were used. Results: Organizational types of medical malpractice were described in the article, as well as the characteristics of legal and forensic problems arising out of their investigation and the ways of their solution with participation of non-state forensic experts. Novelty/originality/value: The authors postulate the necessity of extending the competence of forensic experts when answering questions about defects in the health organization, as well as of the mandatory involvement of the state and/or non-state forensic experts when questioning health professionals on «medical cases».
