Situational approach in the investigation of crimes committed against foreign citizens

Introduction: the article discusses a situational approach to the investigation of crimes committed against foreign citizens. A significant increase in crimes, the victims of which are foreign citizens, is due to the increase in migration flows that occurred in connection with globalization, the strengthening of trade, labor and other relations with the participation of foreigners. Materials and Methods: the research methods were analysis, synthesis and generalization of scientific literature on the research problem. Results: the analysis of crimes against foreign citizens is carried out and three groups of victims are identified; 1) foreign tourists staying on the territory of the Russian Federation for a short time; 2) foreign citizens arriving on the territory of the Russian Federation for a short time and carrying out labor activities; 3) foreign citizens - students temporarily arriving on the territory of the Russian Federation in order to receive education. The features of the investigation of cases involving foreign citizens are presented. The factors contributing to the commission of crimes against foreign citizens of these groups are determined. An algorithm for applying the situational approach in the investigation of crimes against foreign citizens is presented. It is noted that the situational approach reflects, on the one hand, the uniqueness of each investigative situation, on the other, it reveals the typicality of common features, their repetition, which contributes to the typification of situations according to different criteria and for different types of crime, taking into account objective and subjective factors.
