The article deals with the problem of the practice of administrative legislation in the field of migration and the observance of constitutional human rights. In particular, the issues related to the observance of the constitutional right to respect for family life in the appointment of administrative expulsion of foreign citizens and stateless persons outside the Russian Federation. The author reveals the problem taking into account the provisions of International legal acts and the position of the European Court of human rights, the decisions of the constitutional Court of the Russian Federation and the Supreme Court of the Russian Federation, as well as the published archival materials of the Chelyabinsk regional court. In conclusion, the author concludes that it is necessary to develop a unified approach of judges to the imposition of administrative punishment in the form of expulsion from the Russian Federation, taking into account the provisions of international and national legislation, as well as the position of the European Court of human rights.
