Social responsibility regimentation for crimes against life and health of a newborn as a person in a helpless state

Introduction: in the article, based on the study of statistical data, regulatory legal acts of the Russian Federation and the experience of foreign countries, the social and legal prerequisites of increasing responsibility for encroaching on life and health of a newborn in the Criminal Code of the Russian Federation as a person in a helpless state are investigated. Materials and Methods: the methodological basis of the research is the dialectical method of cognition, as well as logical, system-structural, statistical, comparative legal and concrete sociological methods. Results: the result is the conclusion that the existing differentiation of norms on responsibility for crimes against human life and health is insufficient. Proposals for amendments to Art. 115 and 116 of the Criminal Code of the Russian Federation were formulated, in order to ensure the protection of health and bodily integrity of a newborn person as a person in a helpless state.
