Introduction: it is dealt with the basic socio-psychological factors of unlawful conduct; it is given its nature and consequences. It is focused on what the individual cannot be considered separately from those who surround him/her. Person’s actions are the result of acquired individual experience and external factors. His/her actions are determined by the structure of personality, and personality is the result of a complex process in which social is manifested through internal conditions, the biological nature. Results: it is investigated the nature of motive and motivation of behavior, the nature and structure of justice as a determinant of behavior and its types. It is given the outlines of the socio-psychological factors that were investigated in the scientific literature. It is characterized the behavior theories of motivation developed in psychology, especially the theory of needs. It is considered individual personality characteristics that contribute to unlawful conduct. It is emphasized that unlawful actions can lead to moral degradation of the individual. This situation becomes particularly dangerous when such degradation occurs to the person discharging imperious powers, having the opportunity to influence the fate of others. Human behavior is affected by the situation, where he/she finds him/herself. It is dealt with the behavior of a person in the crowd. It is emphasized that crowd behavior is almost unpredictable. The fringes who loiter around mentally ill people and criminals join the crowd of people gathered with political or social demands. Such public advocates a kind of detonator explosion and instigator of violence. The concept of «aggression» is not equivalent to the concept of «aggressiveness». It is introduced the individual personality characteristics that potentiate aggressive behavior. It is drawn attention to the importance of pathopsychological determinants of unlawful conduct, which are associated with abnormalities of personality. Mental anomalies complicate human control mechanisms. It is alleged that the action of biological determinants of unlawful conduct is pretty limited. Conclusions: conclusions were drawn that the determination of unlawful conduct is stipulated by combination of factors, each of which performs its specific functions. Along with the overall social, economic, political factors that contribute to unlawful conduct, the psychological and biological factors that determine a particular type of behavior in each case should be taken into account. Unlawful conduct of the individual is the result of a complex interaction of many factors, the effect of which is mediated by specific relations, the situation, where the individual finds him/herself. Necessary component of unlawful conduct prevention is creation of citizens’ legal awareness. State seeking to make progress in illegal behavior overcoming should help ensure that moral values have become significant to humans. The society can protect themselves against offenders not because of their isolation, but by eliminating the causes of unlawful conduct.
