The subsidiary obligation contents in the civil legislations of the CIS countries

This article is devoted to the Analysis of legal contents of subsidiary obligations in civil legislation of CIS countries. In this paper it is proved that, in the framework presented in the civil legislation of CIS the design of subsidiary obligations aims to compensate the injured party all unexecuted portion of obligations by principal debtor by entering additional debtor, guaranteeing to make up the rest of the creditor. Overview of the civil legislation of the CIS countries, regulating legal relations in content close to the obligations of subsidiarity, has shown that, as a rule, they occur on the basis of contractual h the relationship between the creditor and the additional debtor taking the duties to answer for the failure to perform the main part of the obligations of the main debtor. The article concludes that, in the framework of presented structures of CIS civil legislations, establishes rules according to which the injured party is compensated all unfulfilled obligations of the principal debtor part by entering additional debtor, guaranteeing to make up the remaining requirements of the lender. In the analysis of default of obligation relations of civil law and order of the CIS countries, first of all, found their security functions proper fulfillment of obligations. At the same time, as part of the civil law in the CIS structures vicarious liability attempted to put the debtor in a situation where the breach of the obligation has led to disadvantages, adverse consequences for him, where the obligation to pay damages caused by the failure, is laying on the side of a faulty a new commitment to replace unsettled, or in addition to the obligation that was performed improperly. And on the other side using a subsidiary ojbligations in civil legal systems of the CIS countries the aim is to compensate the injured party failure to perform all of the principal debtor of the commitments by entering additional debtor, guaranteeing to make up the remaining requirements of the lender.
