The Relation Between the International, Regional International and National Law Norms in Labor Sphere Regulation

This article analyzes the issues of correlation, priority of application, and the limits of operation of norms from international, regional international, and national legal systems in the regulation of labor and related relations. Private international labor law is a complex set of private and public law norms of various origins, specifically regulating labor relations complicated by a foreign and/or international element. The complexity of these legal relations necessitates the development of a unique method of legal regulation that meets the needs of participants in contemporary labor relations, taking into account the objectives of their legal regulation. It appears advisable to analyze the complexities of applying norms of different legal nature, levels of creation, and procedures of application, combined with the aim of developing, through the functional approach, the essence and order of regulation of labor relations complicated by a foreign and/or international element. Of particular interest are, among other things, the conflicts of laws and certain regulatory gaps in the legal regulation of the labor of international civil servants of the Eurasian Economic Union (EAEU), who, on the one hand, are governed by EAEU law, and on the other hand, operate within the jurisdiction of the host state of the relevant EAEU bodies. In any case, compliance with international labor standards remains necessary in the regulation of such legal relations. These and other issues call for specialized approaches to the regulation of labor relations, which is the subject of this research.
