The definition and family composition of the residential premises owner

The paper analyzes the problems of legal regulation and implementation of the definition of family members of residential premises owner. Purpose: to analyze the issues connected with the definition of family members of residential premises owner. The methodological framework of the research is based on the set of methods of scientific cognition such as analysis, synthesis, analogy and comparison and on specific scientific methods such as formal-legal and technical-legal. The main legal features of family members of residential premises owners are revealed and examined. The concept of the “family” has mainly psychological character, not legal character. That is why any attempts to formulate the definition of the “family member” based on not legal category of the family can cause some problems. The research made it possible to define the main legal features of the family members of residential premises owner, such as the necessity to satisfy the requirements of the article 31 of the Housing Code of the Russian Federation; official check-in the residence; absence of any other agreement (other legal grounds) between the person and the owner on using the residential premise; absence of rights of use of the other residential premise obtained earlier. In the paper the content of each feature is examined.
