Elements of a crime as an information model

This article examines the fundamental category of the elements of a crime from the perspective of modeling theory. It is argued that the use of the term “elements of a crime” in the context of a legal model allows for the unification of opposing concepts regarding its normativity and reality. It is noted that, to date, there are no clear boundaries between the understanding of legal models and legal constructs, including in the field of criminal law. It is proposed to define the elements of a crime as an informationbased, complex-structured model of a crime reproduced in criminal law norms, which reflects the mechanism of interaction between its invariant objective and subjective elements, forming typical social danger.
