Improvement of legislative measures to counter illegal decisions in organ transplantation

Introduction: the article covers the study of the challenges and improvement of the Russian legislation in countering illegal decisions in organ transplantation. Materials and Methods: Russian legislation was theoretical basis for the study. The author analyzed Russian scientific works on the improvement of the legal regulation of organ transplantation and donation in the Russian Federation, main types of threats in illegal transplantation, and other medical and biological aspects relating to the topic of the study. Basing on the various common scientific methods and ways of cognition, as well as selection and analysis of empirical data, modeling, comparison, legal and special scientific methods the author conducted a scientific study of the main legal legislative framework and aspects of the social relation of unlawful acts in transplantation. Results: the subject matter of realizing into the lives of citizens and their relatives, close people, legal representatives the right of transferring their own will with regard to the reluctance to take grafts from them after death, requires complex scientific studies, the implementation of mechanisms to put these ideas into practice also needs significant improvement. Discussion and Conclusions: development of trasplantology leads to numerous abuses. With obvious violations of legal norms, criminals still manage to avoid the criminal penalties they deserve. In order to improve the legal regulation of organ transplantation it is important to develop and legislate mechanisms to ensure that methods to save people are embodied in a tested and proven system for identifying potential donors; development and implementation of a unified database of donor organs and implementation of bioethical education policy, which should be based on stimulation of voluntary post-mortem donation. Such approach could allow to reduce the illegal turnover of donor materials and contribute to the reduction of unlawful acts in organ transplantation.
