The contemporary problems of legal regulation of transplantation

The article are considered the basic tendencies of development and problems of practical application of legal regulation of relations of donorship and transplantation of human organs and tissues, presents a comparative-law analysis of the special legislation of the Russian Federation in the sphere of donorship and transplantation and the innovations of Federal Law of November 21, 2011 № 323-FL “On the Fundamental Principles of Health Protection of Citizens of the Russian Federation”, reveals the lacunas in the legislation and determines the normative-law acts necessary for adoption. The author also investigates the legal nature of the contracts signed when rendering transplant services. Features of civil responsibility when rendering transplant services reveal. Practical recommendations about improvement of legal regulation and law-enforcement practice in the field of transplantology are developed.
