Creating a framework for Russian juvenile criminal justice based on Swiss experience

Presented in the form of an autonomous codified law, the Juvenile CPC of Switzerland, which has no analogues in other models of criminal proceedings, does not raise any doubts about its relevance for the Russian legal science. The importance of differentiated criminal proceedings for adults and children dates back to the nineteenth century, but has much been done to implement this approach in domestic and Swiss law? The author has attempted to answer this question. The article discusses the peculiarities of the legal regulation of minors’ participation in the justice of the Russian Federation and in juvenile criminal proceedings in Switzerland. The general ideas about the age of a juvenile participant in criminal proceedings are defined, the institute of principles of juvenile criminal proceedings, coercive measures, as well as the system of subjects are analysed. The investigated models of criminal proceedings in legislative terms define minors as a more vulnerable category of participants requiring special legal protection; endow them with additional legal guarantees and rights.
