Strategy for legal protection of medical professionals in malpractice cases

Purpose: The purpose of this scientific publication is to summarize the experience of joint work of lawyers (advocates, investigators and judges) and private forensic experts and specialists in the field of forensic medicine and to build the optimal strategy of legal protection of medical workers in malpractice cases on this basis. Methodology: Сriminal and civil malpractice cases, which used findings of private forensic experts and specialists in the field of forensic medicine, are analyzed. Analytical, synthetic (generalization), comparative and system-analytical methods were used. Results: The optimal strategy of legal protection of medical workers in malpractice cases has been developed. Novelty/originality/value: For the first time, contradictions in definition of essence of medical malpractice are systematized and ways of their overcoming with involvement of private forensic experts are offered.
