The paper analyzes little-studied aspects of the genesis of modern theory of law, the formation of which was associated with the justification of a number of, above all, German lawyers of such a disciplinary form of legal science as the “general doctrine of law”. The study emphasizes that the classical theory of law was based on the basic epistemological setting about the study of the structures of the legal system. The modern theory of law can be based on other grounds, so the analysis of the structural theory of law allows us to significantly clarify the meaning and explanatory possibilities of the methods of theoretical analysis of law used today. The name “structural theory of law” is common in Western literature, so both in essence and for the purposes of more accurate identification of views, this name is quite reasonable.
