Subjective error and qualification of driving to suicide by self-immolation (based on the materials of the Republic of Kazakhstan)

The article is devoted to the study of the subjective side of the crime, in which the features of incitement to suicide, including by self-immolation, were revealed. In the course of the study, the concept of «subjective side of the crime» was considered, and one of the most common forms of criminal activity was analyzed - incitement to suicide, which can be carried out by self-immolation. As a result of the study, the main shortcomings in the Criminal Code of the Republic of Kazakhstan were identified, the main of which is the insufficient elaboration of Article 105 of the Criminal Code of the Republic of Kazakhstan. Based on the results obtained, it was concluded that when deciding on the subjective side of the crime, it is necessary to take into account the fact that this act can be carried out negligently, intentionally, as well as with direct and indirect intent.
