The article analyzes the key differences between the requirement to bring to subsidiary liability and the requirement to recover damages. The author concludes that the requirement to bring to subsidiary liability differs from the second type of requirements in terms of the subject of proof, applicable presumptions, as well as the corresponding amount of liability. Each of these methods of protecting the right is to be used depending on the specific circumstances of the case and the specifics of the acts committed by the defendants.
