The influence of the size of court expenses in the form of costs of representation on the access to justice within arbitration and civil processes at the present stage is considered. The article focuses on the relationship between substantive and procedural law in the context of the issue under consideration. The author analyzes the issue of the constitutional right to judicial protection in connection with the introduction of professional representation and the evolution of conciliation procedures.
