Surrogacy as a legal institution

The article considers the general theoretical problems determined by the lack of unity in the family law and the law regulating the peculiarities of application of the assisted reproductive technologies (ART); by the different interpretation of the same terms that have both medical and legal nature in the law enforcement practice; and by the lack of system characteristics of the various elements of legal relations, in which the reproductive rights are implemented with the help of the ART.
