The nature and characteristics of the commercial corporate organization

The article defines the essence of a commercial corporate organization in terms of legal innovations reflected in the Civil code. As a result of the long-term lack of a clear concept of a Corporation in Russia, almost all Russian organizations, including unitary enterprises and their associations, have actually become understood as a Corporation. The Corporation was perceived not so much as a legal, but as a socio-economic phenomenon. In the study of the concept of «Corporation» were studied legal concepts in the main Western European continental legal systems. The authors give a legal assessment of the characteristics of a commercial organization, through the prism of scientific discourse, which distinguish commercial corporations from other organizations. And some of them are peculiar to commercial corporations, and others are inherent in corporations as a whole.
