Бесплатный доступ

Judicial interrogation is a key judicial and investigative action, which is considered in procedural, organizational, forensic, psychological and ethical aspects. Procedural regulation of judicial interrogation is ensured by the norms of the Criminal Procedure Code of the Russian Federation and the Constitution of the Russian Federation, which guarantee the rights of participants in the process, including the presumption of innocence and the right to refuse to testify. Judicial interrogation is a way of obtaining and verifying evidentiary information, which requires improving the methods of its extraction and analysis. Particular attention is paid to the psychological aspects of interrogation, such as establishing contact with the person being interrogated, managing the emotional background and interpreting non-verbal signals. Forensic methods and tactics used during interrogation are aimed at increasing its effectiveness and the reliability of the data obtained. The adversarial nature of interrogation ensures a comprehensive verification of evidence, facilitating the establishment of the truth. The importance of judicial interrogation lies in its role as a tool for forming the court’s internal conviction and ensuring the legality, validity and fairness of the court’s decision.
