Contract freedom in the right of the foreign states: some aspects

Purpose: To Consider is standard-legal fastening and essence of a principle of freedom of the contract in the various states. Methodology: Historic-legal, rather-legal and formally legal methods Were used. Results: In article is standard-legal fastening of freedom of the contract and its some displays in such countries, as the USA, Ukraine, France, Germany, Yemen is considered. The conclusion that fastening of freedom of the contract, its concrete display depends on development of market relations in the concrete country becomes. Position that in the modern conventional law the tendency to protection of the weak subject was outlined in legal relation is besides, proved. Novelty/originality/value: Article is attempt to analyse and compare fastening of freedom of the contract in the various states with a view of development of recommendations about perfection of the Russian legislation.
