Tactical features of establishing the state of a necessary defense or defense of defense in the conditions of countering an investigation

Introduction: The article discusses forensic approaches to understanding the state of necessary defense and excess of defense, counteracting their establishment during the preliminary investigation. The tactical features of the investigator’s interaction with the bodies of inquiry, the use of special knowledge and the conduct of individual investigative actions to establish the state of necessary defense and excess of defense in the face of countering the preliminary investigation are analyzed. Materials and methods: the normative basis of the study is formed by the Constitution of the Russian Federation, criminal procedure legislation and other normative legal acts regulating relations in the course of preliminary investigation of criminal cases.
